Missed Placed Anger Re-Worked Anthony Salazar Sefferino Ramos ENGL-261-20 March 7, 2019 When stories are about a time where people face racism and slavery with the moral of the people of this day and age as it brings much trouble as it meets the controversial topic. As people saw the story â€Å"The Adventures of Huckleberry Finn† by Mark Twain, the story showed the readers a time when Africans were once slaves in America. So, this caused some readers to see this story as supporting racism since it used derogatory terminology and described how treated the black people. Even to this day, this new generation of readers seem to forget what virulent racism is, as they seem to advocate censoring the story â€Å"The Adventures of Huckleberry Finn,† or even not to let kids read it since it could make the young readers a racist, but that is just not true. While this story fits within a narrow line where many can make points as to why the story is or is not racist, but it is indeed a story that clearly goes against racism both in the late 1800s and today. The causes of the story not being racist can be shown throughout its chapters. The story centers on a kid named Finn, who ran away from his terrible father to get back to his hometown to point he faked his death and ran with a slave named Jim who is also running away. Though the story uses the â€Å"n-word,† it never prompted racism since it focuses on the characters’ moral change. For instance, this is clear when the pair later meet two con artists who kept their secret of Jim being a runaway slave but was soon sold off by the con-artist. That is when Finn meets Tom another main character from another one of Twain’s books, and they rescue Jim. Later, Finn gets back home with Jim and Tom to learn Finn’s dad is dead and Jim is now a free slave. Then Tom and Jim went their separate ways, and Finn decides to not stay in his home-town but to continue traveling to have more adventures. This story again demonstrates that the novel doesn’t support racism, but instead goes against racism. Though many people would not agree since people, especially the United States of America do not want to remember their nations dark past. Though many Americans are disgusted that the story uses a racial slur and showcases a part of the countries history that they wish never happened, the story shows it is against racism by not allowing people to forget that slavery did take place and that it was morally wrong. As many Americans grow knowing that racism wrong, they tend to forget that there are times when people need to show why slavery and racism are wrong, but instead, they try to hide that their country did practice slavery or just say it is terrible without reflecting on the past. When Finn says â€Å"get up and hump yourself, Jim! There ain’t a minute to lose. They’re after us!† there is a clear connection to emotion (Twain 147). This shows a change in Finn’s character as an uncivilized kid living in the south because he is showing concern not just of himself, but of Jim, where he could have just been worried about himself and left Jim behind. Then another point in the story, at the end where Twain wrote, â€Å"We had Jim out of the chains in no time† it is showing that slavery is not a positive thing (Twain 289). Jim is now metaphorical and physically freed, he no longer has a chain. This proves the point that the story is not racist or supporting slavery because a man of color is no longer a slave or being discriminated by the people around him. Some readers will still believe it as a story supporting racism, but really this story is about a victim of racism and slavery. Another point as to why the story is not racist is that it brings out the character Jim out as more than a slave. As Emma Milliken describes, â€Å"Huck saw Jim as a stupid, superstitious, escaped slave,† but that is not the whole story (Milliken 1). When a story is made the writer needs to show a character, and the readers need to understand the character fast. In context wise, it makes sense for a man of color to be a slave and simple for the story as this is for children. That is why Jim seems to be a stupid, superstitious, escaped slave, though later in the story Jim is more than meets the eyes. In an article by David L. Smith, he explains, â€Å"Yet he portrays Jim as a compassionate, shrewd, thoughtful, self-sacrificing, and even wise† (Smith 297). As Smith is explaining Jim is more than a slave at the beginning of the story, because Jim impacted and changed Finn’s moral and helped the nurse Tom a thing not many people can or would do and is even harder for someone that a slave. Where we see a one-dimensional character as a slave but is actually a full characterized one where throughout the story people support to see him be free at the end of the story. These parts in the story point out as to why the story is not racist as Jim becomes free at the end. Though people are trying to erase harsh words in the story to lessen the racism, it is not helping people become less racist. When a harsh word that depicts the reason as to why racism is wrong is removed or replaced, it does not reinforce that racism is wrong but removes the strong reason as to why racism is wrong. To replace the â€Å"n-word† with slavery is just making the story lose its meaning as Michiko Kakutani says, â€Å"Nigger, which appears in the book more than 200 times, was a common racial epithet in the antebellum South, used by Twain as part of his characters’ vernacular speech and as a reflection of mid-nineteenth century social attitudes along the Mississippi River† (Kakutani 305). The story is from a time where the n-word and slavery are common, but one has deeper impact to the readers psychology since they give the â€Å"n-word† more power over them and the â€Å"n-word† is mostly used on black people, and slavery is a word used throughout history and not just in the United States of America. Another point is that if the â€Å"n-word† is swapped to something less harsh it will make the story lose its impact on the reader. As Kakutani also says, â€Å"Tampering with a writer’s words underscores both editors’ extraordinary hubris and a cavalier attitude embraced by more and more people in this day of mash-ups, sampling, and digital books-the attitude that all texts are fungible† (Kakutani 305). Kakutani is ultimately stating that if a story of any kind with great writing can be rewritten to an extent to suit a person’s agenda, then any story can be deemed racist and changed to a point its loses its theme that some readers connect to. Then there are people against the story as, Annemarie Hamlin and Constance Joyner wrote, â€Å"The most calamitous, gut-wrenching moment of class occurred when Dr. Hamlin calmly allowed the word Nigger to flow from her lips. Unless blessed with large amounts of melanin, one cannot imagine how from zero to twenty seconds, a trusting smile, willingness to participate, and a steady heartbeat can turn into a confused grimace, an unwillingness to continue, and overwhelming heartbreak† (Annemarie Hanlin, etc 13). Though she is against Huckleberry Finn including the n-word and their class including it, it shows that the word still causes an impact to people and brings up something that not many people would like to bring up. That is why the story with the controversial issue must not be changed as its loses its meaning and people will not talk about the stuff they necessarily will bring up if it weren’t for the story and if the â€Å"n-word† is replaced people will change it to suit their needs. Thus, the story that goes against racism and the ideas of slavery is misunderstood. As some readers believe that Jim being present shows it supports racism and slavery but are wrong as Jim is free at the end of the story. Though dis-proven others will say, Jim, being introduced in the story as a runaway slave is racist. Even though in context it makes sense and his character is more than that as he did an act not many people and as well as a slave will do. Then removing the â€Å"n-word† makes the story less racist but takes away the point as to why â€Å"n-word† is there and takes away that the story is going against racism. Law in Equity and Trust regarding Charities - Essay Example It has a specific legal meaning; the Charities Act 1993 describes a charity as: "Any institution, corporate or not, which is established for charitable purposes and is subject to the control of the High Court in the exercise of the Court's jurisdiction with respect to charities.": s96(1) This tautologous explanation gets us no further, other than to observe that it is the Courts who determine what 'charitable purposes' means according to current legislation and that an organisation cannot be registered as a charity by the Charities Commission if it has been set up under the laws of a foreign country which for these purposes include Scotland, Northern Ireland, the Isle of Man, or the Channel Islands. Overall this description in itself is unsatisfactory since it promotes uncertainty, and where there is uncertainty in the law there will be litigation. Whilst on the face of it the definition of what a charity is should be found in the Charities Act, the Courts actually refer to the Charitable Uses Act 16011 to determine the definition of a charity, despite the fact that this legislation has been repealed. The Courts follow the 'spirit and intention' of the 1601 Act and the definition of 'charity' has been developed through statutory interpretation and case law precedent arising predominantly from disputes over wills, taxation status and/or challenges against decisions made by the Attorney General on behalf of the Charities Commission. Examining the case law suggests that organizations will be recognized as charitable if they have the following characteristics: The trust must have a charitable character The trust must be exclusively charitable The trust must (on balance) be beneficial The trust must benefit the public The trust must not distribute a profit Charitable Character Lord MacNaughten in Income Tax Special Purposes Commisoners v Pemsel [1891] identified four divisions of charitable purposes namely; 1) The relief of poverty; 2) The advancement of education; 3) The advancement of religion; and 4) Other purposes beneficial to the community. Exclusively Charitable All the purposes to which a trust may use its assets must be charitable. The classic case was Maurice v Bishop of Durham [1805]. That particular trust failed since it was expressed to be for charitable or benevolent' purposes, and not everything that is benevolent' is recognized as charitable in English law. Beneficial There is a presumption that charities which fall under the poverty, education or religious objects are beneficial. In the past the Courts generally sought to find an analogy between the purpose of the proposed charity and the 1601 Act: Williams Trustees v IRC [1947]. More recently the cases have also sought analogies with decided cases. For example in Scottish Burial Reform & Cremation Society v Glasgow Corporation [1968] it was held that the promotion of low cost cadaver disposal (cremation) as it was of benefit to the community, within the 'spirit and intendment'' of the Charitable Uses Act 1601 and analogous to other charities that had themselves been deemed to be analogous to charities in that list. A Brief History of the Jews of Brazil Essay The history of Jews in Brazil is a unique case, because we do not know of many other countries in which they have been significantly present in the very first movements of that nationrsquos history, continuously participating in its economic and social development. In fact, since the ldquodiscoveryldquo of Brazil to the present time, the Jews, almost without interval, openly or disguised, have been integrated into the processes of formation of Brazilian nationality. My aim in this paper is to provide a summary of Jewish history in Brazil by highlighting four major historical periods The First Portuguese Period (1500-1630) The Dutch Period (1630 -1654) The Second Portuguese Period (1654-1822) and The Cosmopolitan Period (1822-1966). br / The First Portuguese Period (1500-1630)br / ?When Portugal was at the height of its expansion in the world, in 1500, Brazil was ldquodiscoveredrdquo by the kingdom. It was then simply military glory, coupled with the desire to enlarge the Catholic faith, that compelled the Portuguese to their grand maritime expeditions (Grinberg 15). But just these reasons alone would not have sufficed to promote the extraordinary expansion of Portugal. The great cycle of the Portuguese conquests would not have been achieved without the long period of scientific discoveries and improvements that preceded it, in which the Iberian Jews played such a key role. As a prime example of this involvement, in Henry the Navigatorrsquos quotNautical School of Sagresquot, the first Portuguese academy of navigation(founded in 1412), was employed one of the most famous cartographers of the fifteenth century, the Jewish Yehuda Cresques, whose main task was to teach Portuguese pilots the basics of navigation well as the production and handling of nautical instruments (Serebrenick and Lipiner 7). br / ?The Jewish contribution to the discovery of new routes and new lands to the Portuguese crown was not limited only to the scientific field, however, but also translated into direct participation in these dangerous travels, including the expedition that resulted in the discovery of Brazil. The fleet led by Pedro Alvares Cabral, included at least three Jewish advisers the astronomer Master John, Pedro Nunes the navigator, and Gaspar de Lemos, an interpreter and ship commander, rightly regarded by historians as partly responsible for the discovery of Brazil (Serebrenick and Lipiner 9). br / ?With increasing incentives of the Portuguese government towards the occupation and settlement of the Brazilian territory, more and more Iberic Jews began migrating to Brazil. Because the wealthier Portuguese and Spanish Jews sustained a lot of the territoryrsquos early economic progress, they were able enjoy considerable freedom of worship and custom (Grinberg 21). This panorama of tolerance contrasted sharply with the wave of hatred and discrimination that swept Portugal, where, like neighboring Spain, persecution was widespread. It is thus understandable that many Jews of 1 / 3 Portugal, affected by overwhelming religious persecution, felt compelled to try a new life in Brazil,which to them seemed like a safe haven where they could materialize their aspirations for peace and freedom. br / ? The Jewish community, thanks to strong immigration and natural growth, reached a reasonable proportion in comparison with the general population, enough to counter the risk of assimilation. Around 1570, however, things took a turn for the worse, as there began to appear signs of restrictions on freedom, which only grew with time (Serebrenick and Lipiner 12). The circumstances soon forced the Jews to return, much like those in the motherland, to a life of great caution and alertness. The first official manifestation of intolerance was found in 1573 in the city of Salvador, which installed an auto-de-fe. Paradoxically, but perhaps on purpose, the first victim was not a Jew, but a Frenchman who was accused of heresy, condemned and burned alive. In Bahia, the Inquisition remained (though inactive for many years) until 1593 (Grinberg 29). br /?In 1618, Bahia was the target of a new visitation of the Holy Office, during which time many Marranos were reported and pursued, among them many wealthy men of the sugar mills. This fact that prompted the first large wave of immigration of Jews within Brazil they left the Northeast in search of the more tolerant South, especially the captaincy of Satildeo Vicente (Satildeo Paulo), which was the most liberal region (Serebrenick and Lipiner 15). Because of the growing persecution of Jews in Portugal in the last decades of the sixteenth century, they began to emigrate not only to Brazil but also, inlarge numbers, to several countries of Western Europe, especially to Holland, where flourishing trade and religious tolerance prevailed (Grinberg 32). This allowed for the rapid formation of a large Jewish community, centered in the city of Amsterdam, rightly nicknamed the quotNew Jerusalemquot. The simultaneous emigration of Portuguese Jews to Brazil and the Netherlands, led to the establishment of a commercial and affective link between the Jews of Brazil and those of Holland (Serebrenick and Lipiner 15). br / The Dutch Period (1630-1654)br / ?The hope of the Brazilian Jews that their lot would improve due to some form of Dutch intervention did not fail. Through a series of attempts at the conquest of the Brazilian Northeast in the years 1624 to 1627, the Dutch finally succeeded on February 15, 1630. The city of Pernambuco was attacked by a powerful fleet of 70 ships, effectively beginning the occupation of the Northeast, which would last until 1654. The years of peaceful Dutch rule were few, but enough to enable the Jews to rapidly flourish economically, socially and culturally, building in Northeast Brazil one of the most thriving communities of the time (Grinberg 35). br / ?With the advent of the Dutch and the consequent deployment of a great religious tolerance, the landscape was changing. Uninterrupted waves of Jews flocked to Pernambuco from several countries, especially from Holland, bringing commercial experience and a wonderful spirit of achievement. These Jews from the Netherlands ndash who were largely former refugees from Portugal,Spain and France had the further advantage of speaking several languages Spanish, French, Ladino, Dutch, besides the most important, Portuguese, which was the language spoken in Brazil (Grinberg 35). A great number of them served as interpreters for the thousands of men in the Dutch army and navy, consisting of mercenaries Dutch, English, French, German, Polish and others who did not speak Portuguese. From simple interpreters, they increasingly became businessmen, merchants and landowners, coming to, in effect, virtually control the economic life of Brazilrsquos New Holland. The main street of Recife (in Pernambuco) was known as quotStreet of the Jewsquot and the port was called quotpier of the Jewsquot (Serebrenick and Lipiner 17). br /. The Second Portuguese Period (1654-1822)br / ?With the fall of Recife and subsequent surrender of the Dutch, the Jewish community in northeastern Brazil became largely scattered. A small portion of the people resigned to staying in the country, dispersing through its territory, while the majority opted for emigration. Of these, one group consisting of the richest and probably most connected in the Netherlands decided to return to Holland, while most preferred to face the unknown, venturing into more distant stops throughout 2 / 3 the Americas Guyana, West Indies and New Netherlands in the United States. Numerous Jewish settlements began to appear to the North, one of which would eventually lead to the extraordinary Jewish community of the United States of America (Grinberg 52). In North America, a group of 23 Jewswho left Recife immediately after its fall, camped on September 12, 1654, on the margins of the Hudson, in the village of New Amsterdam (now New York). br / ?As already mentioned, the exodus that took place after the expulsion of the Dutch did not cover the entire Jewish population of Northeast Brazil, since a good number of Marranos resolved to remain on the land they had learned to love. These remaining Jews eventually were able to peacefully spread throughout Brazil, including in areas of the Northeast itself, minimizing the appearance of their Jewish origin (Serebrenick and Lipiner 23). Unfortunately, the flames of persecution were to be once again fanned by the Inquisition. This new wave of terror unfolded for about 70 years, especially violent in the periods 1707 to 1711 and from 1729 to 1739, making the first half of the seventeenth century perhaps the darkest period of Jewish history in Brazil (Serebrenick and Lipiner 26). Only after 1770 would the conditions come to place that would forever eradicate the cancer of the Inquisition. To this day no one knows for sure how many Jews from Brazil fell victim to the Portuguese Inquisition. br / The Cosmopolitan Period (1822-1966)br / ?Once the country was made independent from the Portuguese crown, in 1822, full freedom of conscience was established. In the second half of the century, Jews from various countries of Western Europe French, English, Austrians and Germans ndash began to come in force to Rio de Janeiro and its neighboring states, especially in Sao Paulo and Minas Gerais(Serebrenick and Lipiner 31). Another large group emigrated from Morocco to the Amazon region. The two settlements the Amazon region and Rio de Janeiro did not seem keep any significant relations and had, moreover, some different characteristics (Grinberg 61). The Amazon community was more stable, while in the South, the Jews originating in Western Europe came in order to flourish and then return to their country of origin, although many would end up staying in Brazil (Grinberg 61). br / ?In the last decade of the nineteenth century Jewish immigration grew, multiplying the diversity in countries of origin and also the in regions where immigrants came to settle. Whereas until then the Jewish immigrants came almost exclusively from North Africa and Western Europe, now there were waves of Jewish immigrants from the Eastern Mediterranean Greece, Turkey, Syria, Lebanon and Palestine as well as Russia and neighboring countries. These settled mostly in the Southeast (Rio de Janeiro, Sao Paulo and Minas Gerais), but also spread out in smaller groups to many other states, both to the South and Northeast. br / ?Though the scope has been very limited and many details necessarily left out, I have sought to give a brief account of Jewish life in Brazilian history. Personal Narrative- Curiosity and Me How many people wonder about holes in the ceiling and cracks on the floor? When did they happen? What caused them? Or what about when you see a cigarette in the toilet and wonder who had the guts to smoke in the girl's bathroom that day and why they chose that brand of cigarette, or why they even smoke at all. And even if people do think about these things, why? For what purpose? I guess I do it out of boredom. But is boredom really an excuse? I mean, really, how bored can a person get? I don't guess it is boredom after all, probably curiosity, which can build to all sorts of lengths, and I believe it most certainly starts there. How else can you explain why I want to know what happened to a certain somebody when a certain somebody else, punches them in the eye? I am almost positive it stems from curiosity and, that is where and how I try to make sense of this story. It begins on a nice hot July morning, with birds singing and flowers in full bloom; ok, not really. But how awesome would it be if it worked out that way. It really would put something beautiful into this mesh of words. Actually it really didn't have a starting place, but starting people. A band. All the people in this band and all the people that surrounded this band were a part of my life for almost eight months. I don't really understand why, but at first I really did enjoy hanging out with these people. I guess maybe because they were 'cool', but I mean we never really did anything cool. So basically we sat around pretending to be cool, because we were considered cool. Or maybe it was just the others that were considered cool. In this village, immediately after a woman gives birth, she only stays for few hours and resumes to her normal roles. This shows how men in Malian Manianka are not concerned with their marriages by not carrying on the women’s duties after birth to allow them recover. There is inequality among families in this town because no one has permission to choose his/her preferred family; instead, the community chooses for them. Monique the midwife is an example of such family whereby her marriage resulted from the cultural practice of choosing husbands.
